Agreement to Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Caribbean Drone Memorials LLC (“Company,” “we,” “us,” or “our”), a limited liability company organized under the laws of the Commonwealth of Puerto Rico. These Terms govern your access to and use of our website located at www.caribbeandronememorials.com (the “Site”), including any content, functionality, and services offered on or through the Site.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.


Eligibility

You must be at least eighteen (18) years of age to use this Site or engage our services. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.


Description of Services

Caribbean Drone Memorials LLC provides aerial ash scattering memorial services over the Caribbean Sea off the coast of Puerto Rico using FAA-licensed drone operators. Our services include, but are not limited to:

  • Coordination and scheduling of drone-based ash scattering ceremonies.
  • Receipt and secure handling of cremated remains shipped via USPS in compliance with applicable postal regulations (BOX-CRE).
  • Professional video recording and photography of the scattering ceremony.
  • Production and delivery of edited keepsake video and media to authorized family members.
  • Full chain of custody documentation from receipt of remains through ceremony completion.

The specific scope, pricing, scheduling, and terms of any individual service engagement will be governed by a separate service agreement or booking confirmation provided at the time of purchase. In the event of any conflict between these Terms and a separate service agreement, the service agreement shall control with respect to the specific service engagement.


Use of the Site

Permitted Use

You may use the Site for lawful purposes only and in accordance with these Terms. You agree to use the Site solely for the purpose of learning about our services, submitting inquiries, and engaging in communications related to our memorial services.

Prohibited Conduct

You agree not to:

  • Use the Site in any way that violates any applicable federal, territorial, state, local, or international law or regulation.
  • Use the Site to transmit any advertising, promotional material, spam, or any other form of unsolicited communication.
  • Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
  • Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or that may harm the Company or users of the Site.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
  • Otherwise attempt to interfere with the proper working of the Site.

Intellectual Property Rights

Our Content

The Site and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, icons, images, video, audio, the “Caribbean Drone Memorials” name, the “Remembrance. Elevated.” tagline, design elements, software, and the compilation thereof — are the exclusive property of Caribbean Drone Memorials LLC or its licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except as follows:

  • Your computer or device may temporarily store copies of such materials incidental to your accessing and viewing those materials.
  • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

Your Submissions

Any information, feedback, suggestions, ideas, or other materials you submit to us through the Site or in connection with our services (“Submissions”) are non-confidential and become the sole property of Caribbean Drone Memorials LLC. We shall be free to use, reproduce, modify, and distribute any Submissions for any purpose without acknowledgment or compensation to you. This provision does not apply to personal information governed by our Privacy Policy or to ceremony-related content (such as details about the deceased or ceremony preferences), which is handled exclusively in accordance with our Privacy Policy and any applicable service agreement.


Ceremony Media and Content

Ownership

Video recordings, photographs, and edited media produced by Caribbean Drone Memorials LLC during a scattering ceremony (“Ceremony Media”) are the intellectual property of Caribbean Drone Memorials LLC. Upon delivery of the final edited media to you, we grant you a perpetual, non-exclusive, non-transferable license to use the Ceremony Media for personal, non-commercial purposes.

Use Restrictions

You may not use Ceremony Media for commercial purposes, public broadcast, or redistribution without our prior written consent. You may share Ceremony Media privately with family members and loved ones.

Testimonial and Marketing Use

We will not use any Ceremony Media for marketing, testimonial, promotional, or public purposes without your prior written consent. If you provide consent, you may revoke it at any time by contacting us in writing.


Cremated Remains — Chain of Custody and Liability

Shipping and Receipt

You are responsible for shipping cremated remains to us in compliance with all applicable USPS regulations, including BOX-CRE requirements for the mailing of cremated remains via Priority Mail Express. We are not responsible for loss, damage, or delay caused by the shipping carrier during transit to our facility.

Our Custody

Upon confirmed receipt of cremated remains at our facility, we assume responsibility for the secure handling, storage, and scattering of the remains in accordance with our standard chain of custody procedures. We maintain detailed documentation — including timestamps, photographic records, and GPS coordinates — throughout the process.

Scattering

All scattering ceremonies are conducted in compliance with applicable FAA regulations (14 CFR Part 107), EPA regulations regarding ocean disposal (40 CFR 229.1), and any applicable territorial or local laws. Cremated remains, once scattered, cannot be recovered. By engaging our services, you acknowledge and accept the irreversible nature of the scattering process.

Weather and Environmental Conditions

Scattering ceremonies are subject to weather and environmental conditions. We reserve the right to postpone or reschedule a ceremony if conditions are unsafe or unsuitable for drone operations. We are not liable for delays caused by weather, airspace restrictions, FAA temporary flight restrictions (TFRs), or other conditions beyond our reasonable control.


Disclaimers

“As Is” Provision

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CARIBBEAN DRONE MEMORIALS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the materials on the Site in terms of their correctness, accuracy, reliability, or otherwise.

Service Disclaimers

While we strive to provide the highest quality memorial experience, we do not guarantee specific aesthetic outcomes of video or photographic media, as results are influenced by weather, lighting, environmental conditions, and other factors beyond our control. All ceremony media is produced with professional care and best efforts.


Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CARIBBEAN DRONE MEMORIALS LLC, ITS OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, SERVICE PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

  • YOUR USE OF OR INABILITY TO USE THE SITE.
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE.
  • ANY CONTENT OBTAINED FROM THE SITE.
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE EXCEED THE AMOUNT YOU PAID TO US, IF ANY, DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations set forth above shall apply to the fullest extent permitted by applicable law.


Indemnification

You agree to defend, indemnify, and hold harmless Caribbean Drone Memorials LLC, its officers, members, managers, employees, agents, and service partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys’ fees) arising from or related to:

  • Your use of the Site.
  • Your violation of these Terms.
  • Your violation of any applicable law or the rights of any third party.
  • Any information or content you submit through the Site that is inaccurate, incomplete, or misleading.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the Commonwealth of Puerto Rico located in San Juan, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.


Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.


Waiver

No waiver by the Company of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.


Entire Agreement

These Terms, together with our Privacy Policy and any separate service agreement executed in connection with a specific service engagement, constitute the sole and entire agreement between you and Caribbean Drone Memorials LLC regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.


Changes to These Terms

We reserve the right to revise and update these Terms at our sole discretion at any time. All changes are effective immediately when posted and apply to all access to and use of the Site thereafter. We will update the “Last Updated” date at the top of this page when changes are made.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page periodically so you are aware of any changes, as they are binding on you.
